While Breyer agreed #Drumpf engaged in #unconstitutional overreach of #PosseComitatus act and blocks #Feds from deploying #military to engage in “arrests, apprehensions, searches, seizures, security patrols, traffic control, crowd control, riot control, evidence collection, interrogation, or acting as informants” the order states unless they submit a valid rebuttal...so whatever...you can bet #Drumpf Mighty #MilitaryMinions are working on a virulent response as to their awesome powers via #DOJ in #DC...

Judge Orrick ruled that #Drumpf #ExecutiveOrders were “unconstitutionally vague and violate due process” not to mention #Coercive #Unconstitutional and in violation of the #Constitution’s mandated "separation of powers" as well as the #SpendingClause plus Fifth and Tenth Amendments.

How long til' #GOP robed calendar pinups #Alito, #BrettKavanaugh, Clarence Thomas, Neil Gorsuch, John Roberts and Amy Coney Barrett all just say he can do whatever he wants?

#SCOTUS in Texas v Johnson, 491 US 397 (1989), & reaffirmed in US v Eichman, 496 U.S. 310 (1990), ruled that due to the #FirstAmendment to the #US #Constitution, it is #unconstitutional for a #government (whether #federal, #state, or #municipal) to prohibit the desecration of a #flag, due to its status as "symbolic speech."

The cities & counties that sued said billions of dollars were at risk.

Orrick, who was nominated by Obama, said the EOs & “executive actions that have parroted them” were an #unconstitutional “coercive threat.”

In May, #DHS published a list of >500 “#sanctuary jurisdictions,” saying each one would receive formal notification that the govt had deemed them noncompliant. It also said it would inform them if they were believed to be in violation of federal #criminal statutes.

In a memo to #Congress, #DOJ said it agrees with a lawsuit attempting to strike down #grants that are reserved for #colleges & #universities where at least ¼ of undergraduates are #Hispanic or #Latino. Congress created the program in 1998 after finding Latino students were going to college & graduating at far lower rates than #white students.

DOJ ofcls argued the program provides an #unconstitutional advantage based on #race or #ethnicity.

That #Trump is raising so much #money for his group has confounded some #Republicans.

Some of Trump’s most loyal supporters have argued that he should try to run for a third term, despite it being #unconstitutional. Trump’s aides have argued that he would be foolish not to accept money that is essentially for the taking, & that the assets can be used to target Trump’s rivals, beginning with Rep #ThomasMassie (R-KY) whom #MAGA Inc. is attacking.

In her ruling, US District Judge Nancy Torresen called the #ExecutiveOrder an #unconstitutional infringement on #FreeSpeech.
"The executive order appears to restrict substantially more speech than necessary to further that end," she wrote.
"The executive order broadly prohibits any speech-based services that benefit the prosecutor, regardless of whether those beneficial services relate to an #ICC investigation of the United States, Israel, or another US ally."
