American #taxpayers will not be paying for the ongoing appeal of President #DonaldTrump's $83 million defamation case, a federal appeals court determined on Wednesday.

A panel of judges on the 2nd U.S. Circuit #CourtOfAppeals on Wednesday denied Trump's request to have #JusticeDepartment lawyers argue in his appeal of columnist #EJeanCarroll's #defamation case against #Trump.

ABC News · Appeals court says DOJ cannot represent Trump in appeal of E. Jean Carroll caseBy Peter Charalambous

The full bench of the #NY-based #2ndCircuit #Court of appeals has *denied* Trump's appeal of #EJeanCarroll's win against him in her #defamation case.

Presumably, #Trump will go to #SCOTUS next.

2 Trump appointees, Judges Steven Menashi & Michael Park, on the bench partly dissent from the en banc decision, saying the judge shouldn't have admitted "propensity" evidence like the Access Hollywood tape.

New #Blog post: Dealing With Nusiance #Abuse Complaints

Yesterday I mentioned that I was having an issue with an individual sending complaints to various service providers - alleging #defamation, #gdpr and AUP violations

This post analyses those complaints in order to (hopefully) help others understand how to respond under similar circumstances

More than 60 years ago, New York Times C. v. Sullivan established that, to succeed in defamation cases, public figures must prove that a published statement is false and that publishers acted with "actual malice." "Murder the Truth," a new book by New York Times journalist and editor David Enrich, discusses the movement to overturn Sullivan, accelerated by Trump, his allies and people who are influenced by them. Nieman Lab spoke to Enrich about his investigation, the journalists he spoke to, and more. "The push to overturn Roe was obviously one of the most coordinated assaults on established Supreme Court precedent, probably in history," Enrich says. "This is definitely not like that — but it’s not an accident that these people were getting up and being given platforms on places like Fox News to make these arguments over and over again."

Nieman Lab“More alarming by the day”: New York Times investigations editor on the legal threats faced by news publishers"The rhetoric and actions that Trump and his allies take at a national level are being mimicked across the country at a much smaller level. Whether they’re Trump supporters or not, they’re taking cues from the President of the United States."

Did the White House just allegedly defame the judges?

"The real constitutional crisis is taking place within our judicial branch, where district court judges and liberal districts across the country are abusing their power to unilaterally block President Trump's basic executive authority," White House press secretary Karoline Leavitt told reporters during a briefing on Wednesday.

Is this similar to Murphy v. Boston Herald case?

Zhang Yazhou was sitting in the passenger seat of her Tesla Model 3 when she said she heard her father’s panicked voice: The brakes don’t work!

Tesla sued her for defamation for complaining publicly about the car’s brakes — and won. A Chinese court ordered Zhang to pay more than $23,000 in damages and publicly apologize to the $1.1 trillion company.

…Since launching his 1st Republican presidential campaign in 2015, #Trump has often attacked & even sued #media outlets whose coverage he dislikes, & has repeatedly criticized US #defamation laws.
A federal judge in 2023 threw out Trump's $475M defamation lawsuit against CNN, in which Trump claimed the network's description of his election #fraud as the "#BigLie" associated him w/ #Hitler. Trump's lawyers…invited the judge to reconsider the #legal standard set in #NYTvSullivan.
