SB 2044: Heightened penalties for #protests near #CriticalInfrastructure

Enhances potential penalties for individuals who protest near existing and planned gas and oil #pipelines by criminalizing acts that interrupt or interfere with critical infrastructure facilities. In addition to prohibiting actual tampering with critical infrastructure property and equipment, the law prohibits "interfering, inhibiting, impeding, or preventing the construction or repair" of a critical infrastructure facility. Further, the law expands the definition of "critical infrastructure facility" to include a "site or location designated or approved for the construction of a facility" such as an oil or gas pipeline. Intentional interruption of a critical infrastructure facility, including by interfering with pipeline construction, is a Class C felony under the law, subject to a penalty of five years' imprisonment, a fine of $10,000, or both. The law also creates organizational liability for such acts: An organization found to have "conspired" with an individual who committed the interference could be criminally liable for ten times the fee imposed on the individual, or up to $100,000.

Increases the penalties imposed for riot offenses. Under the law, participation in a riot is a Class A rather than Class B misdemeanor, punishable by up to one year in prison and a $3,000 fine. Engaging in a riot involving more than 100 people is made a Class B felony, subject to 10 years in prison and a $20,000 fine.

Expands the scope of criminal trespass activity under state law such that it could encompass protests, demonstrations, or other gatherings on private property, if notice against trespass is "clear from the circumstances." The offense could be punishable by up to 30 days in jail and a $1,500 fine. The law also creates an additional, noncriminal trespass offense and allows officers to issue a citation with a $250 fine for trespassing. The law was part of a package of legislation introduced in response to the #DakotaAccessPipeline protests.

Under the law, commission of the offense comprises a Class A misdemeanor, punishable by up to one year in jail and a $3,000 fine.

Would create a new criminal offense that could cover peaceful protesters who choose to wear a mask. The bill would make it a Class A misdemeanor, punishable by up to one year in jail and $3,000, to wear a mask “with intent to conceal the identity” of the wearer while “congregating in a public place with any other individual wearing a mask, hood, or other device that covers, hides, or conceals any portion of the individual’s face.” The bill exempts public gatherings to celebrate “Halloween, a masquerade, or other similar celebration,” but does not include exemptions for masks worn during protests, or for health, religious, or other reasons. As written, the bill could cover a protester wearing a mask to avoid retaliation for their political speech, if there were any other individual in the crowd also wearing a mask—for instance, a medical mask to avoid spreading or contracting a contagious disease.

It's time to start digging in to my mask project!

I need good, solid resources to back up a presentation I'll be giving to the local public. What are the most reliable and ethical doctors, journalists, advocates, research, statistics, or sites that you've seen?

I'll be talking about air quality, advocating environmental justice through citizen science and mutual aid, and my focus is going to be ventilation and masking.

The program is organized by a local group of folks that started putting up air sensors all over town because of toxic chemical leaks from nearby refineries. They got a grant through a university, and they may be able to help me out in getting an air quality sensor so I can test the CO2 in local buildings. I'd also like to be able to pass out some mask samples. I've been trying to find info on other things like sip valves, elastomeric respirator exhaust valve filter adapters, good sites to buy masks and so on.

Since these issues got politicized and the CDC and WHO are increasingly corrupt/hamstrung, finding good info is a fuckin MESS. I could really use some help!

What's been very interesting to me is, the folks who promote masking are usually ALSO right on other issues. Masks are required at the local anarchist book fairs, for example, which to me says a LOT. The people I follow here on Mastodon who are solidly against genocide, fascism, capitalism, and lesser evilism are the SAME people who are solidly for issues like universal healthcare, right to repair, accessibility, direct action, labor organizing, etc etc-- you have a moral consistency that inspires my respect and hope, and I want to learn more from you!

Art Museum Friend-Date 💗 This time, we chose to yammer and sketch in the Virginia Museum of Fine Arts' African art collection, where I became enamored with a 7ft tall serpent mask from the Bwa culture (Burkina Faso and Mali) 🐍

"Serpent masks made by the Bwa are among the most dramatic in all of Africa. Wearing and manipulating the tall mask requires great strength and stamina. To do so, the dancer puts the tall, heavy mask over his head and grips a wooden rod inside the mask to hold it in place as he puts it in motion. Sometimes a performer will twist his head rapidly from side to side, making the mask writhe like a snake. His movements and the mask’s sinuous curves bring the mask to life.

The Bwa regard the wilderness as a realm of both dangerous and life-giving forces. Through masks, they re-create mythical encounters between ancestors and wilderness spirits. The serpent mask celebrates a story in which a python saved a villager’s life by hiding him from raiding warriors in his den. A diviner later instructed the man to create the tall serpent mask in celebration of family and ancestry."

Photographing the "caretos" on the main day of Entrudo, Tuesday, is a challenge in itself. To begin with, Lazarim receives thousands of visitors on this day, each equipped with a "camera" - their smartphone, many wanting to take selfies with the caretos or photos with them. Considering also the narrow streets and not very large squares, the space becomes tight for so many people.
However, with some luck and help from the organization, there are certain moments when it's possible to divert the caretos to a more hidden, more scenic place, where it's easier to photograph them without having mobile phones in view, or people getting into the photos. But note, I have nothing against this, I'm just describing my experience.
It also helps to know the village and the route that the caretos follow on that day, which allows for anticipation and better preparation. Finally, it's also necessary to work with the weather conditions and the time of day, because during the ritual, we encounter different phases of the day, from very strong and high sun to its absence.
