#CriminalizingDissent: #Greenpeace Ordered to Pay $667M to #DakotaAccessPipeline Firm over #Protests

#DemocracyNow, March 20, 2025

"A jury in #NorthDakota has ordered Greenpeace to pay more than $660 million in damages for defaming #EnergyTransferPartners, the corporation behind the Dakota Access Pipeline. The Texas-based pipeline company accused Greenpeace of orchestrating criminal behavior by training and providing funds to the #Indigenous-led protests at #StandingRock. Greenpeace and its supporters, including other #nonprofits and #advocacy groups, argued that the lawsuit is part of a conspicuous attempt by #corporations to destroy the right to #FreeSpeech. Longtime #HumanRights and #environmental lawyer #StevenDonziger, who was part of the independent trial monitoring team observing the trial, says it was purposely held in a region of the country with deep ties to the #FossilFuel industry. Donziger said most of the jurors in the case were connected to the industry and were 'predisposed' to rule in favor of Energy Transfer despite the 'false narratives' presented at the trial. Greenpeace plans to appeal the ruling."

"A 30-day funding freeze enacted by the #Trump administration at #FEMA, the Federal Emergency Management Agency, has caused an immediate pause to the millions of dollars distributed to help vulnerable #nonprofits, including many #Jewish institutions, meet their #security needs.

#Synagogues, Jewish day schools and other organizations that rely on the FEMA funding dispersed through the Nonprofit Security Grant Program have not received reimbursements allocated to them, according to representatives from the Secure Community Network, an organization that provides security services to Jewish nonprofits."

…On top of seeking the elimination of #DEI & “#environmental #justice” teams throughout the federal government, the #Trump EOs also directed agency heads to draw up lists of publicly traded #companies, #universities & #nonprofits to potentially *investigate* over certain DEI practices. The orders also conditioned government contracts & grants on companies & organizations certifying that they don’t engage in DEI practices that may violate non-#discrimination laws.

Many nonprofits rely heavily on federal grants and AmeriCorps members. These nonprofits are being told that they need to scrub anything mentioning diversity, equity, and inclusion if they expect any federal funding or assistance moving forward. (Attached are a couple of examples from a literacy nonprofit called Reading Partners). It's possible that many of Trump's executive orders will be defeated in court, but--even if that happens--the legal process can be slow. Funding is being pulled from programs / nonprofits / research that cannot survive long without it. So, if you see an organization complying with these orders, please do not immediately think less of them. Do not assume they are making these changes because they want to. In most cases they are simply trying to weather the storm and survive long enough to continue helping the communities that depend on their services.

This is such an encroachment on nonprofit independence.

We are private businesses, regardless of mission.

Those grants are good faith contracts.

And those contracts literally allow many of us to deliver public goods that our govt has historically failed to deliver and now refuse to do so.

A lot of the work that goes into making society somewhat livable is often delivered by a nonprofit -- in partnership with a local or federal partner.

Cutting off the sector at the knees will not only mean incredible damage to communities, it heaves hundreds of thousands into unemployment. This means layoffs, furloughs.

Fuck.

Among the rubric (paraphrase) they're using to decide fed grant lines to cut/preserve:

Does this program provide fed funding to ngo's supporting or providing services to removable or illegal aliens?

Does this program provide funding that is implicated by recession or revocation of US Intl Climate Finance Plan?
Does it impose undue burden on domestic energy resources?

Does it provide funding for DEI?

Does it promote gender ideology?

Does it promote or support abortion or related activities in the Hyde Amendment?

If NOT covered in the preceding columns does this program cover activities that should not be supported based on EOs as of Jan 25, 2025.

Y'all.
